This document is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of Capapp IT Solutions marketplace website info@capapp.in.
Your use of the Capapp IT Solutions website and its services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to Capapp IT Solutions including the applicable policies which are incorporated herein by way of reference. By mere use of Capapp IT Solutions, You shall be contracting with MSP Digital Media Pvt. Ltd., the owner of the Capapp IT Solutions Website. These terms and conditions including the policies constitute your binding obligations, with Capapp IT Solutions.
When you use any of the services provided by Capapp IT Solutions through the Website, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Website following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use.
Capapp IT Solutions Website - is defined as the Website under Capapp IT Solutions’s control, whether partial or otherwise including and limited to www.capapp.in, the Website from which these terms of use were accessed from and include the Capapp IT Solutions Services. The term "Capapp IT Solutions", "We", "Us", "Our" shall mean MSP Digital Media Pvt. Ltd., and its affiliates.
Capapp IT Solutions Services - are defined as the services offered by Capapp IT Solutions, including suggestion to Businesses/Organisations/Professionals in selecting desired Software Solution and other services that Capapp IT Solutions offers through its website (collectively, “Capapp IT Solutions Services”).
“User/ Users” include anyone who Uses/Registers to use the website or uses the services provided and those who register to avail the above mentioned services. For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a user on Capapp IT Solutions Website by providing data while registering on the Website as Registered User.
Your use of the Service, including any content, information or functionality contained within it, is provided 'as is' and 'as available' with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this Service.
Capapp IT Solutions hereby grants you a non-exclusive, revocable license to use the Capapp IT Solutions website as set forth in the Terms of Use; provided, however, that (i) you will not copy, resell, duplicate distribute, or make derivative works of the Website in any medium without Capapp IT Solutions’s prior written consent; (ii) you will not alter or modify any part of the website other than as may be reasonably necessary to use the website for its intended purposes; and (iii) you will otherwise act in accordance with the terms and conditions of the Terms of Use and in accordance with all applicable laws. (iv)You may not rent, lease, loan, sublicense, distribute, or otherwise transfer rights to the Service.
Capapp IT Solutions is not responsible for the confidentiality of the User’s Display Name and Password and User shall be responsible for all activities that occur under their Display Name and Password.
By merely visiting or using the Capapp IT Solutions website, You agree that if any information provided by you is untrue, inaccurate, not current or incomplete, Capapp IT Solutions shall have the right to indefinitely suspend or terminate or block access of your membership on the Website.
Your registration on the Capapp IT Solutions website shall be deemed to be your consent to be contacted for any purpose pertaining to sell/purchase or anything for that matter, (i) on the mobile number shared by you even if you are registered with the National User Preference Register (NCPR) and have opted out of receiving promotional calls and messages and (ii) by way of SMS or email notifications or messages in any other electronic form.

The personal information/data provided by you during the course of usage of Capapp IT Solutions website will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations. Capapp IT Solutions shall be entitled to use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes through any social media website. If you object to your information being transferred or used, PLEASE DO NOT USE THE CAPAPP IT SOLUTIONS WEBSITE.

The Software Vendors acknowledge and agree that in fulfilling the obligations under these Terms of Use, Capapp IT Solutions and each of the Software Vendors is an independent controller and third party to the other with respect to Personal Data and will not process the Personal Data as joint controllers. They will individually determine the purposes of processing.
Use of the website is available only to persons who can form a legally binding contract. If you are a minor i.e. under the age of 18 years, you may use the Capapp IT Solutions website only with the involvement of a parent or guardian.
Any alteration of the material or use of the material contained in the Website for any commercial purpose is a violation of the copyright of Capapp IT Solutions and/or its affiliates or associates or of its third-party information providers. You are not permitted to use the Marks, in any manner, without first obtaining the written permission of Capapp IT Solutions or its vendor or third party that own and control the Marks.
The Site may include links to certain websites, materials, or content developed by third parties. Capapp IT Solutions has not reviewed all of the sites linked to its Internet Site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Capapp IT Solutions of the Site. Use of any such linked website is at Your own risk.
Capapp IT Solutions gives an option to Software Vendors to either remove or modify their Software on the Capapp IT Solutions website. Any of the Vendors who wish to modify or remove their Software from the website, may inform about the same by sending an email at V.Kumar1087@gmail.com.
For the services bought, you have to make a one-time payment. The Users have an option to remit the payment either in Indian Rupees or U.S Dollars.
The Capapp IT Solutions Service is billed in accordance with our pricing schedule and all payments are non-refundable. There will be no refunds for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. If you cancel, you will not receive a refund for any service already paid for.
Capapp IT Solutions lists the Softwares of the Vendors in the order in which it deems appropriate. Capapp IT Solutions recommends that YOU determine the appropriate Software according to your best judgment and YOU shall not hold Capapp IT Solutions or its affiliates liable for your decision based on the order of the Software listed.
MSP Digital Media Pvt. Ltd. or its suppliers own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or disassemble any aspect of the Service.
These Terms will remain in full force and effect while You are a User of any Capapp IT Solutions website. Capapp IT Solutions reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of Your User Content from the Capapp IT Solutions website and immediate termination of Your ability to access the Capapp IT Solutions website.
Any event beyond the reasonable control of the Parties, and which is unavoidable notwithstanding the reasonable care of the party affected, and shall include but not limited to war, insurrection, riot, civil unrest, sabotage, boycott, embargo, explosion, fire, earthquake, flood, unavoidable accident, epidemic, act of God, action or inaction of any governmental official or agency (civil or military) and refusal of any licences or permits, if properly applied for.
Any dispute, controversy or claims arising out of or relating to these terms of use or the breach, termination or invalidity thereof, shall be settled by Arbitration in accordance with the provisions of the Indian Arbitration and Conciliation Act, 1996. The place of Arbitration shall be at Ahmedabad, Gujarat.
Capapp IT Solutions reserves the right to make changes to the policies, and these terms & conditions at any time. You will be subject to the policies and terms & conditions in force at the time, unless any change to those policies or these conditions is required to be made by Law or Government authority.
The Services offered through Capapp IT Solutions website contain certain trade-marks, logos or service marks (“marks”) which are owned by the respective brand owners/Vendors or its applicable Assignors and Capapp IT Solutions does not have any ownership or claim over the said marks.
During regular intervals, Capapp IT Solutions may update its Agreement and/or Policies for the Customer and all Customers shall be bound by the latest applicable updated Agreement and/or Policy.
Any consultant /partners /affiliate or anyone who submits leads to Capapp IT Solutions under the Lead Partner/Consultant Partner or any other partnership program of Capapp IT Solutions must hold the ownership of the submitted leads at the time of submitting the lead.
